1. About these Terms
These Website Terms govern use of the Heart In Diamond Canada pages of the Heart In Diamond website (the “Site”). The Site is operated by NAD Services LLC, doing business as Heart In Diamond, 622 1/2 S Cloverdale Ave, Los Angeles, CA 90036, USA (“Heart In Diamond”, “we”, “us” or “our”).
These Terms apply to browsing, submitting an enquiry and using Site features. They do not themselves create an order for a memorial diamond or jewellery. A purchase is made only when the customer signs the applicable Purchase Order Form (“POF”), makes the required payment and we accept the order in accordance with the POF and the Agreement to Purchase.
2. Site content and enquiries
The Site describes made-to-order memorial diamonds and optional jewellery, certificates and engraving. Photographs, renderings, diamond characteristics, availability, prices, production estimates and delivery information are illustrative or preliminary unless they are expressly included in an accepted POF. We may correct genuine errors and update Site content before an order is accepted.
An enquiry, cart submission, request for a quote or selection of a payment preference is not an offer accepted by Heart In Diamond and does not require us to begin production. A manager will confirm the available options, price, payment schedule, sample requirements and order-specific estimated timing in the POF.
3. Permitted use
You may use the Site for lawful, personal and non-commercial purposes. You must not interfere with the Site or its security, access data or accounts without permission, introduce harmful code, impersonate another person, submit unlawful material, scrape the Site at scale, or use the Site in a way that harms other users or Heart In Diamond.
4. Intellectual property
The Site and its text, images, designs, trade names, logos, software and other content are owned by Heart In Diamond or its licensors and are protected by applicable intellectual-property laws. We grant a limited, revocable, non-transferable licence to view the Site for personal use only. No other use, copying, republication, commercial exploitation or creation of derivative works is permitted without our prior written permission.
5. Privacy, cookies and communications
Our Privacy, Cookies and Company Contact Policy explains how we handle personal information, source-material information, cookies and optional advertising/analytics technologies. We send operational communications needed for an enquiry or order. Marketing email or text communications are sent only where permitted by applicable law and you may use the unsubscribe method in the message to stop marketing communications.
6. Links and third-party services
The Site may link to third-party services or websites. Their content, availability and privacy practices are governed by their own terms and policies. A link does not mean that Heart In Diamond endorses the third party.
7. Availability and liability
We take reasonable care in operating the Site, but cannot promise uninterrupted, error-free or secure availability. To the extent permitted by law, we are not liable for losses arising solely from inability to use the Site or reliance on preliminary Site content. Nothing in these Terms excludes or restricts rights, remedies, warranties or liabilities that cannot lawfully be excluded or restricted, including mandatory consumer-protection rights that apply in a customer’s province or territory.
8. Changes
We may change these Terms for future Site use by posting an updated effective date. A change does not alter an already accepted POF unless the parties agree in writing or applicable law requires otherwise.
9. Applicable law
Mandatory laws that apply to a Canadian consumer, including the laws of the consumer’s province or territory, continue to apply and prevail over any inconsistent term. Nothing in these Terms selects a law or forum in a way that removes a mandatory consumer right.
